What is the meaning of detention in law?

The word detention simply means when any person is arrested or taken into custody. It can be legal as well as illegal.

What is meant by a Detention Order?

A detention order is a type of court order that can be made at a bail hearing. If the judge or justice of the peace makes a detention order, you will remain in custody until your case is finished, or you are released on a bail review.

Types of Detention Orders:

  • Detention Order (DO) for youths.
  • Weekend Detention Order (WDO).
  • Short Detention Order (SDO).
  • Home Detention Order (HDO).
  • Preventive Detention Order.
  • Detention without trial.

What is the purpose of detention?

The purpose of assigning detention is to punish misbehavior. Therefore, the goal of detention is to reduce future occurrences of the behavior being punished.

Execution of detention orders:

A detention order may be executed at any place in India in the manner provided for the execution of warrants of arrest under the Code of Criminal Procedure, 1973 (2 of 1974).
